At Rodriguez Law Firm, Inc., we are founding criminal defense attorneys who were previously state prosecutors. How Indiana’s Point System Works
The state of Indiana assesses point values for convictions of traffic violations, ranging from 0-10 depending on the infraction. Any points will stay on your record for two years from the date of conviction. If you are convicted of two or more offenses within a one-year period, you may be required to take a driver’s safety class or risk suspension of your driver’s license. Our Indiana traffic ticket attorneys can help negotiate terms with the prosecutor on your behalf.
Some of the most common traffic infractions and their point values include:
- Driving one to 15 miles per hour over the speed limit: 2 points
- Driving 16 to 25 miles per hour over the speed limit: 4 points
- Driving 26 or more miles per hour over the speed limit: 6 points
- Not using headlights: 2 points
- Broken brake lights or signal lights: 2 points
- Illegal U-turn: 4 points
- Running a stop sign or ignoring a yield sign: 4 points
- Tailgating/following too closely: 6 points
- Driving on a suspended license: 8 points
- Racing/speed contest: 8 points
Indiana Traffic Violation Defense
Nearly everyone gets a traffic ticket at some point in their lives. You may have been ticketed for any of the following offenses:
- Reckless driving
- Speeding
- Failure to yield
- Improper lane changes
- Failing to wear a motorcycle helmet
While it is not a traffic violation, but a criminal offense, driving under the influence of alcohol or drugs is a serious charge. We have considerable experience with operating while intoxicated (OWI) cases and can craft a strong defense for you.
We also take cases involving leaving the scene of an accident. This is another serious criminal vehicular offense that requires an experienced defense lawyer.
Traffic violations and criminal offenses must be addressed immediately. Having 20 points on your license will trigger a one-month suspension. Additional points will require longer suspensions; 42 points results in a one-year suspension.
Protecting Your CDL And Your Career
There are a number of different types of commercial license violations. A CDL driver can risk their license and livelihood with convictions for traffic violations, an accumulation of tickets and points, or CDL violations. We defend clients who are facing CDL violations including:
- Equipment or logbook violations
- Hours of service violations
- Violations of local weight restrictions
- Driving violations, like speeding or tailgating
