What happens if your teenager is arrested for shoplifting?

We do our best to teach our children right from wrong from a very early age. One of those lessons is that stealing is wrong, and they could be in serious trouble when they’re caught.

We can’t be by our children’s side 24/7, so all we can do is hope that they remember the values we instilled in them. Unfortunately, sometimes they don’t.

What is the penalty for shoplifting in Indiana?

If your child shoplifts and is under 18, it is considered a delinquent act, and the case will likely be handled within the juvenile justice system rather than adult court. This system focuses more on rehabilitation rather than punishment and recognizes that teenagers are still developing cognitively.

The court will consider several factors when deciding the outcome of your child’s case, such as the value of the items stolen and if they have a prior record. Expected outcomes might include:

  • Restitution for the stolen items
  • Community service
  • Counseling sessions aimed at addressing behavioral issues and preventing future offenses
  • Probation, during which your child must adhere to rules and regulations set by the court

In more severe cases, or if your child has a history of offenses, more stringent penalties could be applied, such as detention in a juvenile facility.

Your child’s court record will be kept confidential and only available to authorized individuals. It’s important to note that their criminal record isn’t automatically expunged when they turn 21. They will need to petition the court for expungement.

As a parent, it’s vital that you support your child during this challenging time. Foster an environment of open communication so you can understand their motivations and help address any underlying issues. You and your child should also work with someone who can guide you through the juvenile court process and help you understand your rights.
